The Cabinetworks Group family of brands recognizes the importance of protecting the privacy of all information provided by our users. We created this Privacy Policy guided by a fundamental respect for our users’ right to privacy.

This Privacy Policy applies to Cabinetworks Group and all of its affiliates (collectively, “Cabinetworks Group” or “we”, “us” or “our”), although there are some differences in features and functionality among our websites (for example, not all websites allow for the direct purchase of replacement parts and accessories).   1. Information collected and processed by us

We collect information about users through (1) their registration or submission of inquiries related to some of our products and services; (2) their participation in certain activities on our websites, including contests and polls; (3) their submission of information pursuant to a posting on a Careers page; and/or (4) their navigation of our websites via the use of cookies and other tracking technologies. We do not require users to disclose name, email, physical address, or telephone number to visit and navigate our websites, but we do collect this information if and when users are required or requested to submit it to us as described below. Below is a summary of how we use and processes users’ personal information, depending on how they use our websites.

  1. Information automatically collected

When users visit our websites and click on various links (i.e., request pages from our server), our web server automatically collects some information about the users, including their IP addresses, geographic location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of users’ service use. The collection of this information is necessary for us to administer and improve our websites to provide the best user experience for website visitors. From this information we compile broad demographic information about our users to aid in our legitimate business interest of improving advertising or the usefulness of our websites for our users.

When using your mobile device to visit, access or use our websites, then additional categories of information that we collect may include:

  • Your name associated with your mobile device
  • Your telephone number associated with your mobile device
  • Your geolocation
  • Your mobile device ID information

Some of our family of brands’ websites use cookies (text files placed on your computer) to deliver content specific to users’ interests and to honor their preferences. This information is used to assist us in creating websites that will serve the needs of our users.  We encourage users to check their current browser settings to confirm they reflect their preferences with respect to our using cookies on their devices. We may also use tracking pixels (clear GIFs or pixel tags) that are embedded on a page of a website or in communications such as email messages. These technologies help us verify when a certain page of a website is viewed, when a message or advertisement is opened, when links are clicked and other content in a message is viewed, and the originating source of a click or view.

We also work with service providers and advertising partners that use cookies, tracking pixels, and other tools to collect information about your visits to our websites and your behavior while on the websites. This information is used to deliver targeted advertisements to you across the internet based on your activity on our websites. In addition, in order to achieve our legitimate interest of providing our users with a better customer experience, some of our sites use Google Analytics, a web analytics service provided by Google, Inc. (Google).

Google Analytics uses cookies to help us analyze how users in general use our websites. The information generated by the cookie about use of a Cabinetworks Group website will be transmitted to and stored by Google on their servers. Google will use this information for the purpose of evaluating users’ use of a Cabinetworks Group website and compiling reports on website activity for website operators.

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. Google is certified under the EU-US Privacy Shield, which provides a certain level of data protection with respect to the processing of data by Google. Users may block the use of Google Analytics’ analysis by either downloading and installing the Google Browser Plugin and opting out of the use of their cookies or by selecting the relevant setting in their browser, which you may access through the links above. We operate social media pages on third party networks and have social media icons on our Website. When you visit or link to our social media pages, data is processed both by us and the applicable social media provider. Social media providers are unaffiliated with us, and we are not responsible for the content or privacy practices of social media providers.  Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

If you would like to opt-out of accepting cookies altogether, you can generally set your browser to not accept cookies or to notify you when you are sent a cookie, giving you the chance to decide whether or not to accept it. However, certain features of our websites or other services may not work if you delete or disable cookies. While you are free to decline cookies, doing so may prevent you from taking full advantage of the features of our websites.

  1. Information you provide to us
  • Contacting us

We collect the information that you provide to us when you contact us by email, telephone, chat or through a contact form.

Contact us forms are hosted on all websites and allow customers to send requests for information and initiate warranty claims.  We collect personal information such as first and last name, address, email address, and phone number.  We use this information to fulfill our customers’ requests. From time to time our interactions with you will be conducted over the telephone or video-conference, and such telephone calls and video conferences may be recorded.

Our websites may utilize a chat feature to provide customer support. Use of the chat feature is completely voluntary. Chat sessions are recorded and stored in our customer relations management platform. We may use or disclose the chat session information in accordance with this Privacy Policy. If you do not consent to these terms, please do not use the chat feature and contact us via email.

We may now or in the future provide customer support via chatbox or email that utilizes artificial intelligence (AI) and natural language processing (NLP) to understand customer questions and automate responses to them, simulating human conversation.

  • Setting up an account

When setting up an account on a Cabinetworks Group brand website, users will be asked to provide personal data, such as their name and email address. This information will be stored and processed by us to fulfill or in furtherance of a contract or prospective contract between a user or the user’s organization and us. Users may deactivate their customer accounts or notify us of their objection to us holding and/or processing the information they provide with respect to their account at any time by contacting that brand’s customer service team. In either case, we will delete their information and deactivate their account.

  • Signing up for newsletters or entering Cabinetworks Group-sponsored contests

We may also store and process email addresses provided by our users to send out email newsletters and promotional email to our users about services and products offered by our websites. If users want to opt out of receiving these communications, they can click on the “Unsubscribe” link in any newsletter or promotional email and we will delete their contact information.

Furthermore, we may occasionally sponsor a contest or conduct a poll on one or more of our websites where, in order to participate, users must enter personal information, including name, phone number and address. We will collect and process this information in furtherance of our users’ desire to participate in such contests and polls.

Occasionally, we may conduct a contest or poll through one of our third-party marketing agencies. In such cases, the collection and processing of participants’ personal information will be done by such third parties and subject to such third parties’ own privacy policies.

  • Purchasing Products

Some of our websites support an e-commerce site to facilitate the purchase of replacement parts or accessories. We collect personal information such as first and last name, address, phone number, payment card information and billing address that we use to enable the processing and fulfillment of orders. We also support account creation for purchasers of replacement parts and accessories so that customers are able to review and track current and historical orders. 

  • Finding a Dealer

Our websites may provide “find a location” functionality so that we can connect customers to a dealer and request a quote.  We collect first and last name, email address, phone number, and zip code Information is used to connect a prospective customer with their requested dealer.

  • Applying for a position with us

If you inquire about a career with us through a website’s careers page, you will also be asked to provide personal information about yourself, including your resume. We will use the personal information of job applicants solely for employment evaluation purposes.

 

  1. Information received from third parties

We may receive personal information about you from our parent, subsidiary, and/or affiliates; public databases; and other third parties, when they share their information with us, including trade partners such as home builders, dealers, and home centers, in connection with providing quotes, locating dealers and fulfilling orders.

 

  1. Children’s online privacy protection

We do not knowingly collect contact or personal information from children under 13. If we become aware or are notified that we have personal information belonging to someone under the age of 13, we will promptly delete the information.

  1. How we use the personal information

We use the personal data we collect for the following purposes:

  • For general business purposes, including managing your account and relationship with us, responding to enquiries and requests, and administrative purposes.
  • To provide, maintain, and protect our websites.
  • To monitor the performance of our websites and improve your user experience.
  • To respond to your inquiries and provide the information you request, including locating dealers, providing quotes and fulfilling orders, including through our business partners.
  • To complete transactions that you initiate.
  • To communicate with you, including to provide status updates, transactional emails and other service communications, to provide you with notices about your account and to contact you through telephone, text, email or chat, as permitted by law.
  • To send you marketing communications.
  • To fill employment positions.
  • To communicate with you for research purposes, including to request your participation in surveys.
  • To satisfy legal obligations and compliance requirements under laws and regulations applicable to us and our affiliates.
  • To develop, improve and test certain of our products and services.
  • To offer and administer sweepstakes, contests, and similar promotions;
  • For other purposes that we tell you about when you register or provide data about yourself to us.
  • For other legitimate business and lawful purposes.

We may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the websites, including for any other contemplated uses of your personal data not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them. 

  1. With whom we may share your personal information
  • Affiliates. We may share information between and among our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership.
  • Third-party providers. We share your personal data with third parties who perform services on our behalf, including without limitation our technology providers, hosting providers, customer relations management platforms, payment processors, communications providers, analytics providers, advertising platforms, job hosting providers, third-party sponsors of sweepstakes, contests, and similar promotions, software developers and professional advisors.
  • Social Media. You may choose to interact with us on social media, for example by following, commenting on, or sharing content.  Based on your social media privacy settings, most social media platforms, like Facebook, analyze how you interact with us, other companies, and combine it with other information to target advertisements.
  • Dealers. If you request a quote, we will use your data to connect you with a dealer. Dealers are independent third parties, and we are not responsible for the privacy practices of our dealers. Dealers may have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with them.
  • Business partners. We may share personal information about you with our trade partners such as home builders, dealers, and home centers, in connection with providing quotes, locating dealers and fulfilling orders.
  • Third-party websites. With respect to third-party websites linked to a Cabinetworks Group website, including social medial platforms, once a user clicks on such third-party website, he or she will automatically be connected to that website. We do not control or manage these websites or their collection, processing or use of our users’ personal information. As such, we recommend reviewing the privacy policy and terms of use of those third-party websites before users submit their personal information on non-Cabinetworks Group websites.
  • Business transfers. We may share your data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.
  • Legal compliance. We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us.
  1. Text Messaging

For customers that place orders with Cabinetworks Group – We will text order information (updates and confirmations) to your phone for Cabinetworks Group Michigan, LLC brands. Cabinetworks Order Updates – Message frequency may vary. Cabinetworks will use this program to send out order updates to our customers. The updates will notify them the status of their order and shipment/delivery information. Reply ‘Help’ for help or contact 866-540-4970 for support, or by email logisticsteam@cabinetworksgroup.com. Each text message will provide the customer with the ability to opt out of future text communications with the following prompt: Reply ‘Stop’ to stop. Message and data rates may apply, Carriers will not be liable for any failed or undelivered messages.

We will not share or use your mobile number for any other purpose. We will only use the information you provide to transmit your text message. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the Service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate, or incomplete we may refuse your access to the service and pursue any appropriate legal remedies.

  1. Retention and security of your personal data

We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. We will retain personal information required to comply with privacy requests, to manage active accounts, as required by law, in order to resolve disputes, or to enforce our agreements. We may also retain copies of your personal information for disaster recovery purposes, to prevent fraud or future abuse, or for our legitimate business purposes.

Notwithstanding the generality of the foregoing, we store email addresses until the user requests to be unsubscribed or removes themselves through any self-service tools offered to the user. 

We do not store payment card information; rather we utilize a third-party payment processor and store only an electronic receipt that sets forth confirming payment details, such as purchase date, the expiration date of the payment card and the payment ID, but not complete payment card information.

We take reasonable administrative, physical and technical precautions to protect your personal data and communications between us.  This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your data that they will protect the data with reasonable safeguards. 

No Internet or e-mail transmission is ever fully secure or error free, however.  We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control.  Users assume the risk of security breaches and the consequences resulting from them.  Please be careful in deciding what information you send to us via email or over the Internet. 

  1. Your Privacy Rights, Choices and Disclosures

This section is subject to specific disclosures on privacy rights set forth below. We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction, which may include the right to request the correction, modification or deletion of your personal information and the right to opt out of the sale or sharing of your personal information (as applicable). We will do our best to honor your requests subject to any legal and contractual obligations.  If you would like to make a request, cancel your account or request we delete or no longer use your account information to provide you Services, contact us at privacypolicy@cabinetworksgroup.com or make changes to any user profile information connected to your account. Section (B) below describes the rights of residents of California (or another jurisdiction that has adopted laws substantially similar to the California Consumer Privacy Act).

You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication or contacting us at privacypolicy@cabinetworksgroup.com. Some non-marketing communications may not be subject to a general opt-out, such as communications about transactions, disclosures to comply with legal requirements, software updates and other support-related information.  If you do not wish to receive any service-related emails from us, you have the option to deactivate your account.

Subject to local law, you may have additional rights under the laws of your jurisdiction regarding your personal data, such as the right to complain to your local data protection authority and the right to appeal our decision regarding a data access request.

You may be able to disable cookies through your browser settings, but if you delete or disable cookies, you may experience interruptions or limited functionality in certain areas of our websites.

California Consumer Privacy Act Disclosures. If you are a resident of California (or another state that has adopted laws substantially similar to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”)), you have the right to request:

  • The categories of personal information (including sensitive personal information if applicable) we have collected about you;
  • The categories of sources from which the personal information is collected;
  • The business or commercial purpose of collecting, selling or sharing personal information;
  • The categories of third parties with whom we share or sell personal information;
  • The categories of personal information about you that we have disclosed for business purposes; and
  • The specific pieces of personal information we have collected about you.

Additionally, you have the right:

  • to know the length of time we retain your personal information;
  • to request deletion of your personal information;
  • to request the correction of any inaccurate data;
  • to opt out of the sale or sharing of your information (if applicable);
  • to limit the use of sensitive personal information (if applicable); and
  • to not be discriminated against for exercising any of your CCPA/CPRA rights.

In the last 12 months preceding the effective date of this Privacy Policy, we have shared (as defined under CCPA/CPRA) consumers’ personal information in the context of cross-context behavioral advertising. You may use your cookie settings preferences or enable the Global Privacy Control in your browser to opt out of the sharing of your personal information for cross-context behavioral advertising.

Any sensitive data we collect is used only for a business purpose and not for the purposes of inferring characteristics of a consumer.

We do not sell or share personal information for monetary consideration under CCPA. Personal data may be provided to our service providers, contractors and, pursuant to Sections 1798.140(ad)(2)(A) and 1798.140(ah)(2)(A) of the CCPA, to third parties.

How We Verify Your Request. In order to process your request, you must provide us with the following personal information, which will be used solely for the purpose of verifying your identity:

  • Name
  • Email address
  • Phone number
  • Residential address to which parts were shipped or at which customer service/warranty care was provided

Upon receipt of this information, we will compare the personal information you provide in connection with your request to the consumer information we have in our systems and applications to determine whether or not we have any of your personal information.  We may also require that you submit your request via standard authentication procedures (i.e., log into your account with username and password to submit a request) and/or provide information about any historical transactions to ensure you are the person you say you are. If this information or these processes are insufficient to verify your identity and assess your privacy request, we may need to ask for additional information.

Designating an Authorized Agent. You may designate someone to submit requests and act on your behalf (an “Authorized Agent”). To do so, you must provide us with written permission to allow your Authorized Agent to act on your behalf.

California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed.  If you are a California resident and want such a list, please send us a written request by email to privacypolicy@cabinetworksgroup.com with “California Shine The Light Rights” in the subject line. 

California Do Not Track Disclosure: We use tracking tools on our websites to provide targeted advertising on third party websites unless the user requests not to be tracked. We are implementing a tool designed to detect and honor Global Privacy Control signals from visitors to our websites. The user will have the ability to override the automatic settings from the GPC signal via the cookie banner that is presented on the websites.

 

  1. Users outside the United States

The websites are hosted in the United States and are intended for and directed to users in the United States. If you are a user accessing the websites from Canada, the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through your continued use of the websites, which are governed by U.S. law, this notice and our other policies that govern your use of the websites, you are transferring your personal information to the United States and you consent to that transfer.

Our websites may enable you to access third-party websites, services, or other content. Please note that we do not control and are not responsible for how those third parties may treat your personal information. Instead, you should look to those parties’ policies and practices to understand how they treat your personal information.

We may update this Privacy Policy from time to time and without prior notice to you by publishing a new version on our website to reflect changes in our information practices, and any such amendments shall apply to information already collected and to be collected. Your continued use of the websites after any changes to our Privacy Policy indicates your agreement with the terms of the revised Privacy Policy.  Please review this Privacy Policy periodically and especially before you provide personal data to us. If we make material changes to the way we treat your personal information, we will notify you here, by email or by means of a notice on our home page.  The date of the last update of the Privacy Policy is indicated at the top of this Privacy Policy.
